Below is some information about bankruptcy and things you will need before filing.
 
Chapter 7
 
Straight Bankruptcy for individuals or businesses that don't have the ability to pay existing debts. Discharge your debts while retaining certain property. Some debts cannot be discharged. May reaffirm certain debts (homes, cars, etc). Debtors must qualify for Chapter 7 bankruptcies by applying a "means test".
 
Chapter 11
 
Corporate reorganization plan for businesses or individuals with extensive debts or property. Keep your business operating, while reorganizing your debt. Chapter 11 bankruptcy takes special knowledge. Trust an attorney that understands business and the bankruptcy law.
 
Chapter 12
 
Reorganization plan for family farmers.
 
Chapter 13
 
Personal reogranization plan for individuals who have enough income to pay normal living expenses and contribute to a debt payoff plan. The plans typically run a minimum of 3 years to a maximum of 5 years. Debtor makes monthly payments to bankruptcy trustee typically through a wage order with their employer.
 
Chapter 13 bankruptcy plans help with the following:
1) STOP FORECLOSURE - cure arrearage on home mortgage
2) STOP REPOSSESSION - restructure car notes
3) STOP WAGE LEVY - repay IRS
 
Repay numerous secured creditors and pay some distributions to unsecured creditors. Chapter 13 plans may be used to continue to operate small businesses.
 
Items needed for filing bankruptcy:

3.  List of ALL of your creditors:
            With creditor's name, address, account number, and total amount owed.
            This is for EVERY CREDITOR, (house, car, credit cards, medical bills, etc.)
4.  Estimated monthly budget - your monthly income and your monthly living expenses.
5.  Last six months of your specific payroll stubs (each pay stub).
6.  Copies of the last two years of tax returns.
7.  Itemized list of household goods and appliances, with "garage sale" values for each item.
8.  Copies of the last 3 months of any bank statements for checking accounts, savings accounts and credit union accounts.
